Q. Who should deal with misconduct?

A.

The Manager should deal with misconduct.

The exceptions to this are:

  • When the Manager is part of the problem
  • When the Manager is unavailable to deal with the situation  
  • When the Manager needs someone impartial to deal with a sensitive issue

Ideally, the person investigating the disciplinary matter should be someone different to the person who chairs the Disciplinary meeting and makes the final decision.

Disciplinary matters should be dealt with promptly, fairly and consistently in line with ACAS Code of Practice.
