Q. When can I dismiss someone for long term ill-health?

A.

It is rarely acceptable to dismiss someone for long-term ill health during the first 28 weeks of their absence as this is when their entitlements to Statutory Sick Pay remain in force. 

The dismissal considerations will involve:

  • Ensuring you have rigorously followed your procedures
  • Obtaining solid medical evidence from a GP, Occupational Health or a Psychologist
  • Proving that you have explored every alternative or adjustment to a dismissal

These cases can involve various risks.
